Welcome to The Investor Standard (“TIS”, “we”, “our”, “us”). By accessing or using our website, mobile apps, subscription services, newsletters, research reports, webinars, and other related products (collectively, “Services”), you accept and agree to be bound by these Terms and Conditions (“Terms”).

These Terms are comprehensive and cover: account registration, subscriptions, payment, content licensing, intellectual property, disclaimers, financial advice limitations, liability, data protection, user conduct, community guidelines, third-party content, international use, and operational contingencies.

1. Acceptance of Terms

• Use of any part of our Services constitutes your acceptance of these Terms.
• If you do not accept these Terms, you must immediately cease using our Services.
• These Terms form a legally binding agreement between you (“User”) and TIS.
• By subscribing, accessing, or using our Services, you confirm that you have the legal capacity to enter into a binding contract and are 18 years or older.

2. Services Overview

TIS provides a tiered suite of premium financial content, including but not limited to:

1. Market News & Updates – Daily and weekly market summaries, index movements, sector trends, and global macroeconomic developments.
2. Stock Recommendations & Portfolio Guidance – Curated stock picks, model portfolios, trading insights, and actionable investment recommendations.
3. Research Reports – In-depth equity and sector research, company valuations, market impact studies, and trend analyses.
4. Education & Learning – Webinars, tutorials, guides, and investor literacy programs to enhance investment decision-making.
5. Subscription Plans – Tiered plans offering different levels of access, including News, Investor Starter, Full Stock Picks, and Research Premium.

We reserve the right to modify, suspend, or discontinue any Service, feature, or content at any time without prior notice.

3. Eligibility and User Responsibility

• Services are designed for individuals serious about investing.
• Users must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the confidentiality of your account login details and any associated security credentials.
• Any activity occurring under your account is considered your responsibility, and you must notify TIS immediately of any unauthorized access.

4. Subscriptions, Fees, and Billing

4.1 Subscription Plans

• News Only: Access to daily market news, commentary, and analysis.
• Investor Starter: News + one curated stock pick per week.
• Full Stock Picks: News + all weekly stock picks (typically 5+).
• Research Premium: Full access to News and Stock Picks + detailed research reports (variable number per subscription tier).

4.2 Payment Terms

• Payments are processed securely through approved third-party payment gateways.
• Subscription fees are exclusive of applicable taxes.
• All fees are non-refundable, except as required by law.
• Discounts, promotions, and trial offers are at TIS discretion and subject to specific terms.

4.3 Billing, Renewal, and Cancellation

• Subscriptions are billed monthly or annually, as selected at sign-up.
• Auto-renewal: Annual plans renew automatically unless canceled prior to the renewal date.
• Users may cancel at any time via the account dashboard.
• Cancellation does not entitle a refund for previously billed periods.

4.4 Pricing Adjustments

• TIS may adjust subscription fees at its discretion with a minimum of 30 days’ notice.
• Continued use of Services after such adjustments constitutes acceptance of the new pricing.

5. Account Access and Membership

• Accounts are personal, non-transferable, and restricted to the registered User.
• Sharing credentials or account access is strictly prohibited.
• TIS may suspend or terminate accounts for violations, fraudulent activity, or misuse.
• Access to content is tiered based on subscription level, and attempts to circumvent restrictions may result in account termination.

6. Intellectual Property and Content Licensing

• All materials, including but not limited to text, graphics, logos, data, charts, and software, are owned by TIS or its licensors.
• Users are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use.
• Unauthorized copying, distribution, public display, modification, or commercial exploitation is prohibited.
• Content may include proprietary research methodologies, valuation models, and analytical frameworks, which are protected intellectual property.

7. AFSL Disclaimer and Financial Advice Limitation

• TIS does not hold an Australian Financial Services Licence (AFSL).
• We operate under the exemption in section 911A(2)(eb) of the Corporations Act 2001 (Cth).
• Content is general financial product information and cannot take into account your personal circumstances.
• Users should seek independent financial advice before making investment decisions.

7.1 Risk Disclosure

• Investing involves risk of capital loss.
• Past performance is not indicative of future outcomes.
• All investment decisions are made at the User’s own risk.
• TIS does not guarantee investment returns or outcomes.

8. Privacy and Data Protection

• TIS collects, stores, and processes personal data in accordance with our Privacy Policy.
• Data may be used for: account management, service delivery, marketing, analytics, and legal compliance.
• Users consent to secure processing and storage of their data.
• TIS implements industry-standard encryption and security protocols to protect user information.

9. User Conduct

Users agree to:

• Use Services lawfully and for legitimate purposes only.
• Not attempt to circumvent security measures or access restricted areas.
• Refrain from sharing or distributing offensive, defamatory, or illegal content.
• Avoid unauthorized scraping, data harvesting, or redistribution of TIS content.
• Report any security breaches, vulnerabilities, or misuse immediately.

10. Community and Engagement Guidelines

• TIS encourages constructive discussions, comments, and feedback within user forums or comment sections.
• Inappropriate content, trolling, or harassment is prohibited.
• Users may be warned, suspended, or banned for violations.

11. Third-Party Content and Links

• Services may include links to third-party websites or services.
• TIS is not responsible for third-party content, products, services, or privacy practices.
• Users access such content at their own risk.

12. International Use

• Services are primarily designed for Users in Australia.
• Access from other jurisdictions may be subject to local laws and restrictions.
• Users outside Australia are responsible for compliance with local regulations.

13. Liability Limitations

• To the maximum extent permitted by law, TIS and its affiliates are not liable for any losses or damages, including indirect, consequential, or special damages.
• Liability for personal injury, death, or fraud is excluded except as required by law.
• Users acknowledge that investment decisions carry inherent risk, and TIS is not liable for financial outcomes.

14. Indemnification

• Users agree to indemnify, defend, and hold harmless TIS, its directors, employees, and affiliates from any claims, liabilities, or losses arising from:
  • Use of Services
  • Breach of these Terms
  • Violation of law or third-party rights

15. Modification of Terms

• TIS may update these Terms at any time, with revised versions posted online.
• Substantial changes will be communicated via email or dashboard notifications.
• Continued use after updates constitutes acceptance of the revised Terms.

16. Termination and Suspension

• TIS may terminate or suspend access for breaches of Terms, fraudulent activity, or at our discretion.
• Termination does not relieve the User of outstanding payment obligations.
• Upon termination, all access to content and services is revoked immediately.

17. Governing Law and Dispute Resolution

• These Terms are governed by Australian law.
• Users submit to the exclusive jurisdiction of Australian courts.
• Disputes will be resolved through negotiation, mediation, and legal remedies as necessary.

18. Entire Agreement

• These Terms, together with the Privacy Policy, subscription agreements, disclaimers, and other guidelines, constitute the complete agreement between Users and TIS.
• Any prior agreements or understandings are superseded.
